Maternity Benefit for Miscarriage (60 Days)

We are so sorry for your loss. The law gives you 60 days of paid leave to rest and recover, and SSS pays a benefit for it. Here is what you can expect, explained gently and simply.

Your details

What the law gives you

Under RA 11210, a miscarriage or emergency termination of pregnancy (ETP), including stillbirth, gives you 60 days of maternity leave with full pay. The SSS benefit uses the same formula as a live birth, with 60 days instead of 105.

Example: ₱18,000 monthly salary

  1. MSC: ₱18,000. Six highest MSC: ₱108,000.
  2. Daily benefit: ₱108,000 ÷ 180 = ₱600.00.
  3. 60 days × ₱600.00 = ₱36,000.00.
  4. If employed, full pay for 60 days is ₱18,000 × 2 = ₱36,000.00; the employer adds ₱0.00.

Eligibility and claiming

Please take the time you need. If you have questions about your claim, SSS branches and your HR team can help you with the documents.

Looking after yourself

Physical recovery and emotional healing both take time. You may use the full 60 days. If complications require longer recovery, ask your doctor about sickness benefit or other leave options, and talk to HR — many companies have additional support policies.

For voluntary and self-employed members, the benefit is paid directly by SSS to your enrolled disbursement account once your claim is approved.
