The rest day rules
- You are entitled to a rest period of at least 24 consecutive hours after every six consecutive normal work days (Art. 91).
- Work on your scheduled rest day pays 130% of your daily rate for the first 8 hours (Art. 93).
- Overtime on a rest day pays an extra 30% of the rest-day hourly rate: 169% of your basic hourly rate.
- If you have no regular workdays and rest days, work on a Sunday or holiday pays the 30% premium.
Example: 8 hours + 2 hours OT on a rest day (₱755 a day)
- Hourly rate: ₱94.375.
- First 8 hours at 130%: 8 × ₱94.375 × 1.3 = ₱981.50.
- 2 OT hours at 169%: 2 × ₱94.375 × 1.69 = ₱318.99.
- Total: ₱1,300.49 — that is ₱545.49 more than 10 ordinary hours’ basic pay.
When the rest day is also a holiday (₱755 a day)
| Day | 8 hours worked | Each OT hour |
|---|---|---|
| Rest day | ₱981.50 | ₱159.49 |
| Special day that is also your rest day | ₱1,132.50 | ₱184.03 |
| Regular holiday on your rest day | ₱1,963.00 | ₱318.99 |
| Double holiday on your rest day | ₱2,944.50 | ₱478.48 |
Can my employer require rest day work?
Only in specific cases listed in Article 92 — for example emergencies, urgent work on machinery, to prevent loss of perishable goods, or where the nature of the work requires continuous operation. Even then, the rest day premium must be paid. If you are a monthly-paid employee whose salary uses the 365-day factor, your rest days are already paid, but working on them still earns the 30% premium.
Choosing your rest day
Your employer schedules the weekly rest day, but must respect your preference if it is based on religious grounds. If the schedule changes, ask for it in writing. Keeping a copy of your schedule and timesheets makes it easy to check that rest-day work was paid at 130% — and helps if you ever need to raise the issue with HR or DOLE.
Overtime on a rest day is computed on the rest-day rate: 130% × 130% = 169% of your hourly rate.
